About us

Culm is operated by Tom Proffitt, a sole trader registered in England and Wales. Our website is getculm.co.uk. Our contact email is hello@getculm.co.uk.

When these terms refer to "Culm", "we", "us" or "our", they mean Tom Proffitt trading as Culm. When they refer to "you" or "your", they mean the person accessing the website or placing an order.

By using our website or placing an order, you confirm that you are at least 18 years old and that the information you provide is accurate and complete.

When a contract is formed

Browsing our website and adding items to your cart does not constitute a contract. A legally binding contract between you and Culm is only formed when we send you an order confirmation email confirming that your order has been accepted and is being processed.

We reserve the right to decline any order before that confirmation is sent — for example if a product is out of stock, if there is an error in the price displayed, or if we suspect fraudulent activity. If we decline your order after payment has been taken, we will refund you in full within 5 working days.

These terms and conditions, together with your order confirmation, constitute the entire agreement between us. No verbal representations or prior correspondence form part of this agreement unless confirmed in writing.

Products and descriptions

We make every reasonable effort to ensure product descriptions, images, and specifications on our website are accurate. However, bamboo is a natural material and individual posts may vary slightly in grain, colour, and surface texture. These variations are inherent to the material and do not constitute a defect.

Product images are representative. The appearance of the product on your screen will depend on your device's display settings and may not perfectly reflect the colour of the product you receive.

Where we state dimensions, weights, or specifications, we aim to be accurate to within reasonable manufacturing tolerances. If we identify a significant discrepancy between what is described and what is delivered, we will offer a remedy in line with Section 6 (Returns and refunds).

Prototype and pre-launch information: During our pre-launch period, some specifications (including final dimensions and weight) are subject to change as the product moves from prototype to production. Any material changes will be communicated to waitlist members before orders are taken.

Pricing and payment

All prices shown on our website are in pounds sterling (GBP) and include VAT where applicable. Delivery costs are shown separately at checkout and are not included in the product price.

We reserve the right to change our prices at any time. If the price of a product changes between you placing an order and us accepting it, we will contact you to confirm whether you wish to proceed at the new price. If you do not confirm, we will cancel the order and refund any payment taken.

Payment is processed securely through Stripe. We do not store your payment card details. All transactions are encrypted. By placing an order you agree to Stripe's terms of service in addition to ours.

Your card will be charged at the point of order placement. If we are unable to fulfil your order, we will process a full refund within 5 working days.

Delivery

We currently deliver to UK addresses only. Delivery timescales and charges are set out on our shipping & returns page, which forms part of these terms.

Delivery timescales are estimates and not guarantees. We are not liable for delays caused by the carrier, adverse weather, or events outside our reasonable control. If your order has not arrived within 10 working days of your dispatch confirmation, please contact us and we will investigate.

Risk in the products passes to you when they are delivered to the address you specified at checkout. Title (ownership) passes to you when we receive full payment for the order.

If no one is available to receive a delivery, the carrier will follow their standard redelivery or safe-place procedure. We are not responsible for items lost or damaged after a delivery attempt has been made at the address you provided.

Returns, refunds and your consumer rights

Your statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 apply in full and are not affected by these terms.

Under the Consumer Contracts Regulations, you have the right to cancel any order within 14 days of receiving it without giving a reason (the "cooling off period") and receive a full refund including standard delivery costs. To exercise this right, notify us at hello@getculm.co.uk within 14 days of delivery.

Our own returns policy extends this to 30 days for unused posts in original packaging. This is more generous than the statutory minimum and sits on top of, not instead of, your legal rights.

Sleeve refill orders are consumable items. We are unable to accept returns on opened sleeve orders unless they are faulty or not as described.

If a product is faulty, damaged on arrival, or not as described, you are entitled under the Consumer Rights Act to a repair, replacement, or refund. Please contact us within 30 days of delivery with evidence of the fault and we will resolve it promptly.

Sleeve subscriptions

We offer an optional recurring subscription for jute sleeve refills. By subscribing, you authorise us to charge your payment method at the agreed frequency until you cancel.

You may cancel your subscription at any time with no penalty, no minimum term, and no cancellation fee. Cancellation takes effect before the next scheduled dispatch. We do not charge for a sleeve that has already been dispatched at the time of cancellation.

To cancel, use the link in your subscription confirmation email, log in to your account on our website, or email us at hello@getculm.co.uk. We will confirm cancellation within one working day.

We reserve the right to change subscription pricing with a minimum of 30 days' notice. If you do not wish to continue at the new price, you may cancel before the new price takes effect.

There is no lock-in and no dark-pattern cancellation process. If you want to cancel, you can — in one step, at any time. That's the deal.

Limitation of liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any other liability that cannot be excluded under English law.

Subject to the above, our total liability to you in connection with any order shall not exceed the total amount paid by you for that order.

We are not liable for indirect or consequential losses, including but not limited to loss of income, loss of profit, or damage to property caused by improper use of our products. Our products are designed for normal domestic use with cats. They are not designed to bear the weight of humans or to be used in ways other than those described.

We do not accept liability for losses arising from events outside our reasonable control, including natural disasters, strikes, postal disruption, or failures of third-party services such as payment processors or couriers.

Website use

You may use our website for lawful purposes only. You must not use our website in any way that causes, or may cause, damage to the website or impairment of its availability, or in any way that is unlawful, fraudulent, or harmful.

All content on this website — including text, images, design, and code — is owned by or licensed to Culm. You may not reproduce, distribute, or create derivative works from our content without our written permission, except where permitted by applicable law.

We make reasonable efforts to keep the website available and accurate but do not guarantee uninterrupted access or that all information is current at all times. We may suspend or withdraw access to the website at any time without notice for maintenance, security, or other reasons.

Our website may contain links to third-party websites. We are not responsible for the content or practices of those sites and a link does not imply endorsement.

General

Governing law. These terms are governed by the laws of England and Wales. Any disputes arising from these terms or from your use of our website or products will be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer resident in Scotland or Northern Ireland, in which case you may bring proceedings in your local courts.

Changes to these terms. We may update these terms from time to time. The version in force at the time you place an order is the version that applies to that order. We will notify waitlist subscribers of any significant changes by email.

Severability. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver. Our failure to enforce any provision of these terms does not constitute a waiver of our right to enforce it in future.

Complaints. If you have a complaint about any aspect of your experience with Culm, please contact us at hello@getculm.co.uk. We will respond within 5 working days and do our best to resolve it promptly and fairly. If we are unable to resolve your complaint, you may be entitled to use an alternative dispute resolution service — we will provide details of applicable schemes on request.
